CS Murkomen’s order on shoot to kill is illegal

The order that the Interior Cabinet Secretary Kipchumba Murkomen issued to police to shoot and kill protestors threatening them is very much illegal, a lawyer has said.

Former President of the East African Law Society James Aggrey Mwamu says this is a very unlawful order that must be condemned in the strongest terms possible.

Addressing the press at his Kisumu office today, Mwamu said civil disobedience must be quelled in a peaceful manner and not with shooting of the protestors.

Mwamu says the Police Service have several avenues like using reasonable force, rubber bullets and water cannons to quell riots across the country other than using live bullets.

“Those are situations that are enough to quell riots and not the use of live bullets to protestors,” Mwamu says.

He says the Cabinet Secretary in charge of internal security should know that he will account for his actions like issuing illegal orders of shoot to kill once he leaves the office, adding that he should do things within the confines of the law.

“We want to remind the Cabinet Secretary in charge of Interior Ministry that as a lawyer, he has the responsibility to work within the confines of the law,”Mwamu adds.

Mwamu at the same time has taken issues with the Communication Authority to switch off some media houses live coverage during the Wednesday’s this week protests while condemning the actions.

He says article 34 of the Kenyan Constitution 2010 provides for the Freedom of the press across the country and this should never be curtailed at all.

“We are asking President Ruto to desist from curtailing the media because the media needs to inform Kenyans accordingly within the confines of the law under which they operate,” Mwamu further says.
