 Parliament should reject DP’s impeachment motion

Parliament has been urged to totally reject a motion that is to be tabled today targeting the impeachment of the Deputy President Rigathi Gachagwa.

Former President of the East African Law Society Lawyer James Aggrey Mwamu says the Deputy President has not in any way engage in an act of gross misconduct that warrants his removal from office through impeachment as enshrined in article 150 of the Constitution of Kenya 2010.

Mwamu says by the Deputy President calling for resource allocation for Mount Kenya region does not in any way amount to gross misconduct.

Mwamu says if some people are saying the DP should have advocated for the delivery of services to other parts of the country is okay but does not amount to gross misconduct, breach serious crime committed under the law and does not amount to violation of the constitution of 2010.

“I think at this particular stage, there is no reason why someone should advance for the impeachment of the Deputy President since the accusations does not meet the threshold for his removal from the office through impeachment,” Mwamu says.

Mwamu has urged Members of Parliament to concentrate on more important matters like addressing hard economic times, issue of education especially CBC among others that need to be addressed, adding that the removal of the Deputy President is not a priority.

“I would like to ask Parliament to go slow on the issue of impeaching the Deputy President and we have so many issues which needs to addressed and impeaching the DP is not a priority for Kenyans,” Mwamu says.

Mwamu says a bad precedence should not be set whereby if a sitting President has the majority in Parliament and he wants to remove his Deputy then he does so at will.

“There must be a good reason to remove the Deputy President and Parliament should be very serious about such a motion,” Mwamu adds.

Mwamu at the same time urge ODM Party not to engage in this issue of impeaching the Deputy President because it directly does not concern them as a party, adding that the current political squabbles is not there’s.

The Lawyer has also advised the DP not to drag Raila Odinga’s name into his woes, adding that Odinga is now fully committed into campaigning so as to clinch the African Union Commission’s Chairmanship.
