Ranguma files notice to appeal against High Court’s decision on Election petition.

FORMER Kisumu Governor Jack Ranguma has moved to Court of Appeal where he has filed a notice to appeal against the recent High Court’s decision that dismissed an election petition he filed.

The Former Governor through his Lawyer Richard Onsongo yesterday went to the Court of Appeal where he filed the notice of appeal.

Addressing Journalists after filing the notice of appeal, Lawyer Richard Onsongo said the notice of appeal does not set out the ground of appeal but only says that the petitioner has appealed against the recent High Court decision.

Onsongo says his Client is not satisfied by the recent decision of the High Court which dismissed the election petition hence has moved to Court of Appeal.

He says his client has applied for the certified proceedings, rulings and judgment from the High Court which dismissed the election petition by the former Governor after which the petitioner will come up with grounds of appeal.

 “We have applied for certified copies of proceedings, the rulings and judgment so that we can sit down and from the content and substance of those proceedings, rulings and judgment we can then draw the grounds of appeal,” he says.

Onsongo adds that grounds of appeal will then indicate reasons as to why the petitioner is not satisfied with the recent High Court’s decision.

“The grounds of appeal will contain the specific points on which Mr. Ranguma is dissatisfied by the recent decision of the High Court,” Onsongo adds.

He says after coming up with the grounds of appeal which is contained in a document known as Memorandum of Appeal, the Appellant will file a record of appeal at the Court of Appeal which will give the date of hearing of the appeal based on strict timelines on the rules.

He says a team of lawyers will be looped in to handle the appeal but did not say the number of lawyers intended to handle it.

High Court Judge David Majanja on this January 3 dismissed the election petition number 3 of 2017 filed by the former Kisumu Governor Jack Ranguma where the court found that the petitioner did not prove his case due to lack of sufficient evidence that could convince the court to annul the election of the current Governor Prof. Peter Anyang’ Nyong’o on August 8, 2017.

The High Court dismissed the election petition with cost at shs 5 million where the first and second respondents were awarded shs 2.5 million and the third respondent was awarded shs 2.5 million.
