Lobby files petition against two Cabinet Secretaries over Nairobi River Pollution.

AN Environmental Lobby Group in Nairobi County has lodged a class action lawsuit against the Cabinet Secretaries for Environment, Water and Sanitation and National Environmental Management Authority over the pollution of the Nairobi River and the air in within the City.

The two Cabinet Secretaries are Keriako Ole Tobiko of environment and his Water and Sanitation Counterpart Solomon Chelgui.

The Ufanisi Center through its two registered officials who are the petitioners in the matter seek conservatory orders compelling the respondents to apply the precautionary principle in environmental management. 

The petitioners are Isaiah Luyara and Wilson Yata are the Petitioners in the Suit.

They also pray for compensation for all members of the affected class which would include about seven million residents of the affected counties both upstream and downstream of Kiambu, Nairobi, Machakos, Makueni and Tana River Counties.

Through their lawyer Ken Amondi of Amondi and Company Advocates Nairobi, the petitioners have cited the respondents for a series of constitutional breaches particularly the right to a clean and healthy environment as envisaged under Articles 42, 69 as read with Article 70 of the Constitution of Kenya. 

The petition has been slated for hearing before Justice Kossy Bor of the Environment Court Milimani this September 26.
