Next CJ should ensure Independence of judiciary, says lawyer

THE Country’s next Chief Justice and President of the Supreme Court of Kenya should be one who will ensure the independence of the judiciary, a lawyer has said.

Former President of the East African Law Society James Aggrey Mwamu has urged Judicial Service Commission (JSC) to recruit a competent Chief Justice who will ensure this is done when he or she will replace the retired Chief Justice David Maraga.

He says shortlisted candidates who have been identified and will be interviewed for the position should be able to do this when one of them assume the office.

 

Speaking in Kisumu, Mwamu says such a person should be an independent minded and ensure that court orders are respected and follow to the latter.

 

“The Country needs a Chief Justice who will ensure that the Judiciary is very much independent hence free from interference by the Executive wing of the National Government just like the retired Chief Justice David Maraga did during his tenure,” Mwamu says.

 

Mwamu says the Judicial Service Commission should be firm and competitively recruit the next Chief Justice without interference from any quarters.

 

“We need a Judiciary which should never be swayed and influenced by anybody. This will be very important for the public to have confidence in this arm of the Government,” Mwamu adds.

 

Already, a total of 13 top lawyers, legal scholars and judges will battle for the post of Chief Justice recently vacated by David Maraga who retired last month of January.

 

The person who will emerged the top will be appointed and served as third Chief Justice in the Country after promulgation of the constitution of Kenya 2010.

 

Dr. Willy Mutunga was appointed the first Chief Justice to serve after the promulgation of the Constitution and retired in 2016 when David Kenani Maraga got the position succeeding Mutunga until his retirement last month.
