Public Participation on Proposed E-citizen System Management regulation held in Ksm
Members of
the public in Nyanza region have been engaged in a public participation process
over the e-Citizens System Management proposed Regulations 2026.
The event
that has been organized by the National Treasury has brought members of the
public from the six counties in Nyanza region and the process led by the Director of Government Digital payments at the National Treasury Silas Oswe.
The
proposed regulation known as the Public Management {e-Citizens System
Management} Regulation 2026 seeks to establish a system for the access to and
payment for services offered by a national or County Government entity and
financial reporting of the payments made to or received by the National and
County Government entities.
The System
will be known as e-Citizens system and shall be the official government online
portal through which payments for on boarded public services is made digitally
and where all collections and settlements of revenue are made.
The system
is set to operate as the sole government-designated online portal for the
collection and settlement of all the revenues received for the services offered
by the national or county government entity and accessible through the system.
The regulation
has three main objectives which are to facilitate the access to and payment for
services offered by the National or county government entity as well as facilitating
data collection and reporting for the system enhancement and optimization.
The other
objective is to facilitate transparent financial management and standard
financial reporting as contemplated by the article 226 of the Constitution of Kenya
2010.
On administration
of the system, it shall be hosted, administered and maintained by the National
Treasury.
Section 18
of the Regulation says a person may apply for a refund under the system where a
service paid for under the system was not rendered or where payment was made
twice for the same service and where payment was made to the wrong payment
service provider.
Section 20
says the data collected and maintained under the system shall be handled,
retained and disposed of in accordance with the provisions of Access to
Information Act, the Data Protection Act and any other related legislation.
Participants during the public process held in
Kisumu have raised concerns over the proposed Regulation ranging from the
privacy of the Data that will be provided in the system.
Francis Oduor
says there must be an assurance that data that will be collected for the system
must be safeguarded.
He adds the
regulation must ensure safety and security of the data provided must be
guaranteed.
Audrey
Joyce has raised a concern about the refund through the system, adding that it
should be done in accordance with the available time frame.
There have
been concerns too about the Composition of the Steering Committees where a
section of participants have called on for the inclusion of Members of the
Civil Societies Organizations {CSOs}, the Donors and religious leaders.
