Gachagua can't vie as a President in next year’s polls

Rigathi Gachagua can't vie as a Presidential candidate in the next Year's
General Election after the High Court ruling, a senior Counsel has said.
Former President of East African Law
Society James Aggrey Mwamu says the Law bars the Impeached Deputy President
from running any political post including that of the Presidency.
Addressing the press at his office in
Kisumu, Mwamu said the High Court ruling that upheld Gachagua's impeachment
in the National Assembly is very much in order.
Mwamu says once one is impeached, he
or she remains impeached and cannot vie for any political post or hold any
public office.
He says if the matter moved to Court
of Appeal and to the Supreme Court and the ruling is overturned then he
will be eligible to run for a political post.
"For the Supreme Court to say
that, It is still going to look into what Parliament did because they are not
going to ignore what the National Assembly did," Mwamu says
Mwamu says what the Supreme Court is
also going to look into is whether Gachagua was given two to three more
days would have marshalled more numbers in the Senate, adding that it
would be unlikely that the scenario would have changed.
"I think there is still an
opportunity for him to move to Court of Appeal and Supreme Court to settle some
of the issues which are still outstanding like what are the parameters of
impeaching a Deputy President and to what extend should we have the process of
public participation for example how should the entire country be engaged on
this by Parliament within the shortest time,"Mwamu adds.
Mwamu’s sentiment comes barely a day
after the High Court’s ruling on Gachagua’s impeachment case.
