Corruption has made it impossible for people to realize the fruits of devolution in Kenya

The issue of corruption in various sectors of economy has made it impossible for the people of Kenya to fully realize the fruits of devolution, a Senior Counsel has said.

Former President of the East African Law Society Senior Counsel James Aggrey Mwamu says rampant corruption in the various sectors of the economy of this county has been a major impediment to the full implementation of the Constitution of Kenya 2010 sixteen years since its promulgation in the year 2010.

Addressing the press in Kisumu today at his Kisumu office a few days after the Country marked 16 years since the new constitution came into being 16 years ago, Mwamu said a lot of public money is stolen from Counties hence making members of the public service not to get the essential services required.

He says as a result of corruption, the public has not been able to realize the progress towards social-economic that was set to be attained under the new constitution.

“As a result of corruption, there is no money to buy medicine in public health facilities, for enough functioning agriculture among others,” Mwamu says.

Mwamu says the other thing that has also be an impediment to full implementation of the new constitution is the issue of huge governance Budget where many offices were created under the new constitution like the issue of the nominated senators among other offices.

He adds that Many Kenyans are of the view that some of these positions should be reduced drastically so that a reasonable budget can be in place.

Mwamu says the other issue that should be re-looked into is that of the timelines of 14 days within which a Presidential Election Petition should be heard and determined, adding such a timeline needs to be reviewed.

“In others countries the timeline ranges between 21 to 30 days hence we also need such a timeline and not a long one to hear and determine Presidential Election Petition before the Supreme Court,” he adds.

The people of Kenya last Week on Thursday August 27 marked 16 years since the Country’s new constitution was promulgated.

The New Constitution of Kenya 2010 came into effect after it was promulgated on August 27, 2010 by the then Kenyan President Mwai Kibaki under the Grand Coalition Government.

Since then, the Country has made some gains as a result of the new constitution as well as registering some failures.
