Milling Company over road accident.
A KISUMU based Journalist has sued
a milling company demanding compensation over a road accident that was caused
by the vehicle that belongs to the company three years ago.
Dickens Wasonga who works with
African Press International {API} has sued the United Millers Company limited at
Kisumu court seeking compensation over a road accident that was caused by one
of the company’s vehicles that rammed into his vehicle and he suffered serious
injuries.
After the accident, the scribe’s
car was written off and the matter was moved to court where the driver of the
lorry belonging to the company which caused the accident convicted.
Paul Ngige, who had earlier denied
the charge of careless driving thus setting a stage for a battle in court with
the journalist for two and half years was found guilty of the offence in May
last year and the court ordered him to pay a fine of Ksh. 10,000 or face a six
month jail term.
During the trial, the driver was
blamed for causing the accident when he tried to overtake and rammed into the
car near Migosi junction along Kisumu Kakamega Road on February 7, 2015.
Ngige who was driving the lorry
registered under the name of United Millers was said to be ferrying goods from
Kisumu to Kakamega on the morning of February 7, 2015 when the lorry had a
head-on collision with the journalist’s car.
The scribe who suffered multiple
injuries was immediately rushed to Avenue hospital and had to undergo a major
surgery on his head and remained hospitalized for several months.
The Journalist last week through
Olel, Onyango and Ingutiah Company Advocates filed a suit against the driver
and the milling company.
The suit papers which have been
served by the plaintiff’s lawyers to the defendants includes demands for
compensation for total loss of his motor vehicle medical treatment costs, cost of the suit,
general damages for the pain, suffering and loss of amenities, special cost and
any other or further relief that the
court may deem to grant.
The Chief Magistrate’s court will
hear and determine the case if the defendants fail to enter an appearance
before the magistrate within 15 days.
