Governor Awiti to Appeal High Court decision’s nullifying his re-election.

HOMA Bay County Governor Cyprian Awiti whose re-election in August 2017 has been today been nullified by the High Court in Homa Bay has vowed to appeal against the Judgment.

Awiti says he is not happy with the judgment of the High Court in Homa Bay which has declared his re-election null and void but will respect the Court’s decision which he will now make appeal at the Court of Appeal in Kisumu.

Addressing the press in Kisumu today in the presence of his three Lawyers Prof. Tom Ojienda, Antony Oluoch and Emmanuel Owiti, Awiti said already his legal team has filed a notice to appeal against the High Court’s decision.

Prof. Tom Ojienda, Governor Awiti’s lead Lawyer in the case says the High Court’s decision is not justifiable hence his client has opted to appeal against it thereby has filed a notice to appeal.

“My client is not satisfied with the today’s High Court’s decision to declare his election null and void hence has decided to appeal against it and we have file a notice of appeal,” Prof. Ojienda says.

He says together with his two colleagues, they will prepare the records of appeal which they will lodge in the Court of Appeal in Kisumu within seven days which will be probably next week.

“We have commenced the process of appeal against this high court decision and we are moving to court by next week so as to file the records of appeal within seven days,” Prof. Ojienda adds.

Awiti at the same time distanced himself from a letter going round the social media claiming that he has discredited the judiciary following the ruling that has annulled his re-election in August 2017.

He says he respects the Judiciary and other two arms of the Government and cannot discredit any at any moment.

“I am a firm believer in the rule of the law and never at any point will I discredit the Judiciary,” Awiti says.

Justice Joseph of High Court in Homa Bay has today declared the re-election of Homa Bay Governor Cyprian Awiti citing massive irregularities by the Independent Electoral and Boundaries Commission.


The Court has ordered for afresh election to be conducted in Homa Bay County Gubernatorial seat.


Former Kasipul Member of Parliament Joseph Oyugi Magwanga who filed a petition challenging Governor Awiti’s re-election has praised the High Court’s decision terming it as a victory and justice for all the Homa Bay county electorates who came up and voted on August 8,2017 but their victory was stolen hence making him to move to court.

He says he is very much ready to go for another fresh election as ordered by the  High Court which has declared Awiti’s re-election null and void.
