Notice to ban political rallies
within Ksm CBD is illegal
The recent
notice that the Management of Kisumu City issued banning all political rallies
within the Central Business District is illegal, a lawyer has said.
Former
President of the East African Law Society James Aggrey Mwamu says the ban on
Political rallies within the Kisumu’s CBD is very much illegal and not in order
at all.
Mwamu says
under the Elections Act that deals with the issues of elections across the
country, there is no provision banning political rallies within Central
Business District.
Mwamu who
was speaking after visiting Obwolo Secondary school where he awarded best
students in KCSE 2021 said the Conducting and managing elections across the
country is the sole mandate of the Independent Electoral and Boundaries Commission
{IEBC} and not any other body.
Mwamu argues
that IEBC has not gazetted Kisumu Central Business District as a hotspot where
political rallies should never be held hence rendering the Notice issued by the
City Management of Kisumu null and void.
Mwamu says
by banning political rallies within the CBD, Candidates of Members of County
Assembly of Kisumu for Market/Mlimani ward will also have nowhere to campaign
yet their electorates are in the ward within the CBD.
Mwamu at the
same time have condemned this Monday incident where gubernatorial candidate
Jack Ranguma’s convoy was tear gassed as well as some traders next to Jubilee
Market after he presented his Papers to IEBC and clear to run for the Kisumu
Gubernatorial seat and had a meet-the-people tour.
Kisumu
County government through the city department late last month issued a notice
banning all political activities within the Central Business District.
Kisumu
City Manager Abala Wanga issued the notice saying no politician will be allowed
to hold a political rally within the city Centre.
According
to Wanga the move has been occasioned by the destruction of public property
that happens during such rallies.
The
City Manager said most of the rally-goers vandalize public property within the
CBD, thereby hurting efforts to refurbish the face of the city through
beautification programs.
Abala
said the city shall designate areas of campaigns outside the city Centre,
further adding that those violating the notice will face the law.
In
the run-up to the Africities summit that was held on May 17 to 21 this year,
the city Management of Kisumu also banned the erection of political billboards
and posters within the CBD until the end of the event.
