Court quashes varsity’s decision to shut its Kisumu City Campus abruptly.

The Kisii University Governing Council has suffered a major blow after a High Court in Kisumu has thrown out its decision to close its Kisumu City Campus after giving its about 1,000 students only a one day notice to relocate to its other campuses across the country.

High Court Judge Fred Ochieng in his ruling yesterday said the decision by the University’s Governing Council was unreasonable.

“I find that it is not in the public interest to make a decision to have students whom the university had granted admission to its campus, for the purpose of acquiring an education, being told to ove out of that campus after a one day notice,” said Justice Ochieng in his ruling. 

The court ruled that the Council should have given notice earlier enough before the closure of their Kisumu City Campus on May 10 this year.

Justice Ochieng said the University should have given a reasonable notice to the students and not a one day one.

“Accordingly, I grant an order of Certiorari, and thus do bring into the court , and quash the decision of the Governing council of the Kisii University, to close its Kisumu City Campus, after one day notice,” added Judge Ochieng in his ruling.

The Judge however added that the ruling does not constitute a bar to the University from taking appropriate steps in future.

“Finally, as this is a public interest litigation I order that each party will meet his or her own costs of the application for the judicial review,” the Judge further said.

Addressing the press after the ruling, the lawyer representing the students Ken Amondi welcomed the court’s decision.

“The court has agreed with us that the Kisii University Governing Council made an error when it arrived at a decision to issue a one day notice to students to vacate the campus for its closure,” Amondi said.

The over 1,000 students of Kisii University at their Kisumu City Campus moved to Court and filed for a judicial review after the University’s Governing Council gave a one day notice for them to vacate the campus for its abrupt closure on May 10 this year.
