We have not received a resignation letter from North Kisumu ward rep, IEBC Officer says
The office of the Independent Electoral and Boundaries Commission {IEBC} Kisumu County Election Manager has not received a resignation letter from North Kisumu Ward Representative who wants to vie for the position of the Speaker of the County Assembly of Kisumu.

Patrick Odame, the Kisumu County Elections Manager says the Member of the County Assembly for the North Kisumu Ward is required by law to resign first before he contests for the position of the Speaker of the County Assembly of Kisumu.

Addressing the press in Kisumu today, Odame said this is in line with Article 178 of the Constitution of Kenya 2010.

“The law under Article 178 that each county Assembly shall have a speaker elected by the County Assembly from among persons who are not members of the County Assembly,” Odame says.
The Officer says he will also need to confirm with IEBC Headquarters whether the MCA has written to the Chairman of the Commission in regard to the issue.

“The Kisumu County IEBC office has not received any such communication but I am also trying to find whether he has written to the Chair of IEBC at the Headquarter in regard to the issue,” he adds.

 Article 194 {1} {d}  says “The office of the Member of the County Assembly Speaker becomes vacant if the Member resigns in writing addressed to the Speaker of the Assembly.

Article 178 {1} says: “Each County Assembly shall have a speaker elected by the Assembly from among persons who are not members of the county Assembly.

There has been rumors that the North Kisumu Ward MCA Elisha Jack Oraro who has presented his nomination papers for the election of the County Assembly of Kisumu Speaker’s seat has not resign as an elected MCA in accordance to the law.

However, Oraro who addressed the press today after 30 MCAs declared their support for him maintained that he has resigned as an elected MCA.

He says he is qualified enough to be the next Substantive Speaker should he be elected on Friday this week, adding that after a wider consultation, he has opted to resign as MCA to contest the seat.

He says he will champion peace and development should he be elected as the next Speaker.
