3 Suspended MCAs in Kisumu get back to the Assembly after court order.

THREE Members of the County Assembly of Kisumu who were suspended by the Speaker over alleged grossly disorderly misconduct have gone back to the Assembly after a High court in Kisumu ordered that the suspension be lifted until the matter they presented to court on their suspension be heard and determined.

The Trio Joachim Oketch{Swaga}of Kondele Ward, Jactone Ojwang Ogendo of Nyalenda A ward and his Nyalenda B counterpart Joseph Opiyo Olale yesterday went back to the Assembly and were allowed into the chambers after Deputy Speaker Eric Agolla communicated the Court’s decision to the members when he chaired the session.

The three sat pensively during the entire session of the Assembly until it was adjourned when the Members finished discussing a motion moved by North Nyakach ward Representative Rashid Miruka on effects of floods in Kisumu County.

The Three Members of the County Assembly moved to court on Monday this week to challenge Kisumu County Assembly Speaker Onyango Oloo’s decision to suspend them for alleged grossly disorderly misconduct on April 10 this year during a speaker’s Kamkunji.

Both Joachim Oketch and Jactone Ojwang Ogendo were suspended for 21 sittings each while Joseph Opiyo Olale was suspended for 14 sittings.

Kisumu High Court Judge Justice David Majanja on Monday this week April 16 granted the trio a stay order pending hearing and determination of the application by the three MCAs who are the applicants.

“That in the meantime, leave be and is hereby granted to operate as a stay of the decision of the second respondent dated 10-4-2018 suspending 1st and second applicants for 21 sittings each and 3rd applicant for 14 sittings of the house pending hearing and determination of the application,” says part of the court order.

The three MCAs are the applicants in the matter while County Assembly of Kisumu and Speaker of the County Assembly of Kisumu are first and second respondents.

The matter dated 16-04-2018 has been certified as urgent and has been fixed for inter-parties hearing this Thursday April 19, 2018.
