Siaya Speaker forwards two bills to Governor Rasanga for assent 

SIAYA County Assembly Speaker George Okode has signed the vellum on two Bills and forwards them to Governor Cornel Rasanga to assent them into law.

The two Bills are the Siaya County Emergency Fund Bill, 2020 and the Siaya County Tax Waivers Administration Bill, 2020 for consideration by Siaya Governor Cornel Rasanga Amoth.

The Speaker’s move is pursuant to Standing Order 143(1) of the County Assembly Standing Orders that dictate that the Speaker shall, within fourteen days, forward a Bill passed by the Assembly to the Governor for consideration.

The two Bills were sponsored by Usonga Member of County Assembly Sylvester Madialo and were passed by the County Assembly during its Plenary Session Tuesday, 30th June, 2020.

The Siaya County Emergency Fund Bill, 2020 seeks to establish a Siaya County Emergency Fund which shall enable payments to be made in respect of the county when an urgent and unforeseen need for expenditure for which there is no specific legislative authority arises.

The Bill provides for instances under which the County Executive Committee Member for Finance may make payments from the Fund. 

These include but not limited to when there is public interest; when the event has caused a damage, loss, hardship or suffering to residents of the County or threatens to damage the environment.

The Siaya County Tax Waivers Administration Bill, 2020 shall give effect to Article 210 of the Constitution and Section 159 of the Public Finance Management Act, 2012 as regards tax waivers and the administration thereof. 

It further intends to ensure transparency in the administration of taxes and other revenue and to provide for the procedure and requirements applicable for tax waivers.

Speaker Okode says there have been circumstances of emergencies and disasters within Siaya County which have always to a greater extent made it impossible for a section of the County residents to pay taxes and fees as required of them. 

“Such cases are the COVID-19 pandemic and floods which have hugely affected economic activities within the County. To address such like issues, this Bill seeks to provide for legal framework for the regulation and administration of tax waivers, thereby aligning and giving further effect to Article 210 of the Constitution of Kenya and Section 159 of the Public Finance Management Act, 2012,” Speaker Okode says.
