Kisumu CEC to know his fate as Assembly set to give ruling next week
The County Assembly of Kisumu is set to rule whether the County Executive Committee member in charge of Industrialization is in the office legally or illegally after his impeachment as CEC Finance last year in July.
Nerry Achar will now know his fate next week on Tuesday after an Ad-hoc committee finds out that he is in office illegally.
The committee chairman Jecktone Ogendo, who is the Member of County Assembly of Kisumu  representing  Nyalenda A ward tabled the report in the Assembly yesterday.
Achar who was then in charge of the finance docket was impeached last year in July and labour court in Kisumu upheld his impeachment in March this year after challenging his removal in court.
The committee says it was wrong for Kisumu Governor Prof Anyang Nyong’o to reshuffle Achar after his impeachment since he was found unfit to hold any public office.
Attempts by majority leader Kenneth Onyango to stop the debate on the report flopped as County Assembly Speaker Elisha Jack Oraro ordered for the report to be tabled before the House.
The Kisumu County Assembly Majority Leader had argued that Achar had moved to Court of Appeal to challenge the decision of the lower court and it was improper for the Assembly to discuss the matter.
However, committee member, Steve Owiti said the county attorney and county secretary both appeared before the committee and denied any knowledge of an appeal Achar had lodge at the Court of Appeal.
The ward Representatives learnt that Achar had appealed the lower court’s ruling last week and backdated with Owiti calling upon investigative agencies to seize the matter.
Most of the Members of the county Assembly of Kisumu who debated on the report supported a call on the Governor Nyong’o to relieve Achar from his duties immediately.
Kisumu County Assembly Speaker Elisha Jack Oraro told the House that he will make a ruling next week on Tuesday July 7, 2020 after reviewing all the debates.
