NASA will not
participate in election unless IEBC is overhauled, Kisumu leaders say.
THE National Super Alliance will not participate in the
forth coming repeat presidential election unless the Independent Electoral and
Boundaries Commission is overhauled, two Kisumu County leaders have said.
Kisumu Governor Prof. Peter Anyang Nyong’o and Kisumu County
Assembly Speaker Onyango Oloo said the NASA fraternity will not take part in an
election that has already been bungled before it starts.
Speaking at St. Stephen’s ACK Cathedral in Kisumu during a
Sunday Church service, the two said IEBC must be overhauled and must comply
with the exposition of the judgment of the Supreme Court.
Oloo says there is no need for the country to go to an
election with the electoral body as it is currently constituted.
“As the Nasa fraternity we are not going to participate in
an election whose outcome is already pre-determined and we have made it clear
that unless IEBC is overhauled and it complies with the judgment of the Supreme
Court we will not take part in the forth coming poll, he says.
He says come October 17 this year, without the requisite
conditions as demanded by the NASA, the Alliance will not take part in that
election.
Oloo says Jubilee Government should not try to threaten the
people of Kenya with threats of constitutional crisis.
He adds that the Government as currently constituted is keen
on reinforcing and embedding itself onto the people of Kenya without the
sovereign legimacy that must be given by the people.
“Every student of constitutional law knows it very well that
any constitutional crisis has constitutional cures which is extra constitutional
measures to preserve the state and the nation, in that regard should there
be situation that the President term’s
expires we will be asking for constitutional measures to be put in place and
precisely Chief Justice David Maraga takes charge of the caretaker government
to be deputize by his deputy so as to oversee the election until a new
President is elected and sworn into office,” Oloo says.
Oloo says should there be no election on October 17 then the term of
the current President Kenyatta will expire hence a constitutional crisis will
be in place paving way for a caretaker Government.
Oloo says IEBC after its overhaul has no any other choice
other than conducting free, fair, transparent and credible election in
accordance to the constitution and other election related laws as ordered by
the Supreme Court.
Nyong’o on his part says there is need for an election in an
equal playing field conducted by a fair referee and IEBC as presently
constituted cannot conduct a free, fair, transparent poll in accordance to the
constitution.
“There is no election going to be conducted with the IEBC as
currently constituted, we need an equal playing field conducted by a fair
referee and if these conditions by NASA are not met then there will be no
election,” Nyong’o says.
The Kisumu County Leaders have spoken after Nasa
Presidential candidate Raila Odinga said that the election will be done on irreducible
minimum and on conditions that the Alliance have put before the IEBC which they
want meet before the next repeat Presidential polls.
