 High Court upholds Central Nyakach MCA’s election.

THE High Court in Kisumu has upheld the election of Central Nyakach Ward MCA that was declared null and void by the lower court early this year.

High Court Judge Tripsisa Cherere has turned down the Chief Magistrate’s court earlier decision that had declared the election of Philemon Ojuok as central Nyakach MCA.

This is now a sigh of relief to Central Nyakach MCA Philemon Ojuok after the Kisumu High Court upheld his election after he appealed against the lower court’s decision.

Ojuok who was elected on a Ford Kenya ticket had his election in February this year nullified after Senior Principal Magistrate Christopher Yalwala annulled the election and ordered that fresh elections be held.

The petition was filed by Peter Bodo who lost in the general election.
Ojuok then appealed the ruling where Justice Tripsisa Cherere today ruled that he was duly elected and set aside the earlier court ruling.

Speaking to the press in Kisumu after delivery of the ruling, Ojuok thanked his constituents for standing with him.

He says that the decision of the curt was a true reflection of what transpired during the election.

Ojuok sent an olive branch to those who did not vote for him to join him in service delivery for the people.

He says that Central Nyakach missed out in terms of development in the inception of devolution and promised to scale it this time round.

The Court ruled that the first respondent who is Peter Bodo Okal to pay shs 200,000 to the Appellant who is the MCA Philemon Ojuok as well as to pay shs 200,000 to IEBC who is the second respondent in this matter.
