Court of Appeal upholds Nyamira Governor’s election.

Court of Appeal upholds Nyamira Governor’s election.

The Court of Appeal in Kisumu has today upheld the election of Nyamira Govenor John Nyagarama after dismissing an Appeal challenging his election.

While dismissing the appeal,the court has observed that it had no merit wanting the election of Nyamira County governor declared null and void.

Delivering the judgement on behalf of his two Colleagues, Justice Stephen Gatembu said the appellant Walter Nyambati did not prove his appeal wanting the election of Nyamira Governor who is the first respondent in the appeal declared null and void.

The three Judges in their ruling said the court of Appeal has no basis to interfere with the findings of the High Court which had earlier dismissed the election petition after it found that the petitioner did not prove the case before it then.

The Court has now agreed with the High Court’s Decision which upheld the election of Nyamira Governor after dismissing the election Petition lodged by Mr Nyambati at the High Court in Nyamira.

"There is no evidence to support the allegations brought under the grounds of Appeal by the appellant hence the appeal has been dismissed herein," the court said.

The appeal has been dismissed with cost capping it at sh 1.5 million each to be given to the first and second Respondents.

Immediately after the Judgement, the residents of Nyamira County who had come to listen to the judgement thronged the streets of KISUMU while singing and dancing in praise of Governor Nyagarama.

They chanted phrases like"Kazi Iendelee!!!!!,Kazi Iendelee na Nyagarama!!!(Let the work continue with Nyagarama) as they escort him around Kisumu City. 

Nyagarama later sped off towards Kisumu-Nairobi road while heading to Kisii.
