A YOUTH Group has moved to court wanting the Independent
Electoral and Boundaries Commission {IEBC} to be compelled to release tallied provisional
results of the Presidential Election in the forthcoming General Election in
August this year.
The group known as SUMAWE Youth Group from Kisumu West
Sub-County within Kisumu County wants the IEBC which is the respondent in this
matter be compelled by court to release tallied provisional results of the
Presidential Election six hours after the closure of polling stations across
the country during the August polls.
Through Lawyer Ken Amondi of Amondi and Company Advocates,
three petitioners certify the petition as urgent.
The three petitioners
namely Titus Alila, Jackline Otieno and Francis Ogada of the SUMAWE Youth Group
moved to High Court in Kisumu on Monday this week while arguing that past
experience has shown that delay in announcing Presidential Election Results is
a harbinger for creating anxiety, confusion and at worst violence.
In a sworn in affidavit by one of the petitioners Titus
Okoth Alila has said that the respondent in this matter has singled sourced for
the supply of shs 3.8 billion on the issue of Integrated Election Management
System in the country which would among others ensure electronic transmission
of the Presidential Election Results from the polling station to the national
tallying center.
The petitioner says he believes that it would be the
legitimate expectation of the Kenyan taxpayer that in the view of Integrated
Election Management System, IEBC should be in a position to announce the
provisional winner of the Presidential Election according to the Provisional
Election Results for the entire country within eight hours of the closure of
the polling stations.
High Court Judge Justice Cherere certified the matter as
urgent and ordered that the respondent be served.
The Petition is mentioned on June 19 this year.
The Petition comes barely near two months to the next
General Election to be held in August this year.
